Access to token-related services is restricted to (i) natural persons who are at least 18 years old, fully capable to contract, and tax-resident in a jurisdiction not subject to EU/UN/OFAC sanctions, and (ii) legal entities duly incorporated and not subject to such sanctions.

Token-related services (claiming, holding, transferring, redeeming) require a successful KYC/AML verification under Regulation (EU) 2024/1624 (AMLR) and Spanish Law 10/2010 on prevention of money laundering. We may at any time request additional documents or refuse, suspend or revoke verification at our sole discretion when there are reasonable grounds to suspect non-compliance.

By submitting your KYC data you authorise Web3TrustX and its compliance providers to verify the data, including consultations to public registries, sanctions lists and PEP databases.

WTX is offered as a utility token under MiCA art. 3(1)(9). It does not constitute a security, an e-money token, an asset-referenced token, a deposit, an investment product, nor a claim against Web3TrustX or any third party. Holding WTX does not entitle the holder to dividends, profit shares, voting rights in the company, redemption rights against fiat reserves, or any guaranteed economic return.

The Token grants access to features of the Platform as published from time to time in the technical documentation. Such features may evolve, be paused, or be discontinued without compensation, subject to clause 9 (Service availability).

The vesting schedule applicable to community-distributed tokens is: 25% at TGE, 25% at month 6, 20% at month 12, 15% at month 18, 15% at month 24. This schedule may not be modified unilaterally to the detriment of holders.

Crypto-assets, including WTX, are highly volatile and may lose all of their value. There is no EU deposit-guarantee scheme or investor-compensation scheme covering them. The market for the Token may be illiquid, and you may be unable to sell or transfer the Token at an acceptable price or at all.

You acknowledge that you have read the MiCA Risk Disclosure published at /legal/mica and that you assume all risks associated with holding, using or transferring WTX, including but not limited to market risk, liquidity risk, technological risk (smart-contract bugs, chain reorganisations, oracle failures), custodial risk, regulatory risk, and the risk of total loss.

You are solely responsible for the security of your account credentials and any wallet you link to the Platform. We do not custody your private keys.

You must notify us within 24 hours of becoming aware of any unauthorised use of your account. We are not liable for losses caused by the loss, theft or compromise of your credentials or private keys.

You agree not to use the Platform: (a) for any unlawful purpose; (b) to launder funds, finance terrorism, or evade sanctions; (c) to misrepresent your identity, residency or source of funds; (d) to attempt unauthorised access to our systems; or (e) to interfere with the integrity of the Platform or any blockchain network.

Breach of this clause may result in immediate suspension of access, freezing of pending Token allocations, and reporting to competent authorities.

Web3TrustX does not currently charge a service fee for the community Platform. Network fees (gas) on Binance Smart Chain are borne by the user.

You are solely responsible for determining and paying any taxes that apply to your acquisition, holding or disposal of WTX in your jurisdiction. We do not provide tax advice.

All content, trademarks, software, designs and documentation made available through the Platform are owned by Web3TrustX or its licensors and are protected by Spanish and EU law. No licence is granted other than the limited, non-exclusive, non-transferable right to use the Platform in accordance with these Terms.

The Platform is provided “as is” and “as available”. We may modify, suspend or discontinue all or part of the Platform at any time, including for maintenance, security, regulatory or commercial reasons. We will use reasonable efforts to give prior notice of material changes.

To the maximum extent permitted by Spanish law, Web3TrustX shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, revenue, data, business opportunities or goodwill arising out of or in connection with the use of the Platform or holding of the Token.

Our aggregate liability for direct damages shall not exceed one hundred euros (€100) per affected user, except in cases of wilful misconduct or gross negligence, or where Spanish consumer-protection law forbids such limitation.

We may amend these Terms at any time. Material changes will be notified by email to registered users at least 30 days before they enter into force. Continued use of the Platform after the effective date constitutes acceptance.

Each version is identified by a version code (e.g. “2026-04-29-v1”) recorded in the user's KYC submission for audit purposes.

These Terms are governed by Spanish law. Any dispute shall be submitted to the competent courts of Sevilla, Spain. Consumers may also invoke the protections of their country of residence under EU consumer-protection law and may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
